Usage Policy – Imkan Platform (IMKAN.TOURS)

Owner & Operator: Imkan Platform is owned by Bee Global Group and operated by Bee Global Bahrain W.L.L ("the Platform" or "we").

Introduction

This policy sets out the general rules for using the Imkan Platform to protect the rights of all parties and maintain a safe, reliable environment. By using the Platform, you agree to fully comply with this policy. Any violation may result in suspension or termination of your account as outlined below.

Legal Framework: This policy is governed by and interpreted under the laws of the Kingdom of Bahrain, while also taking into account international regulations (such as GDPR) where applicable to users outside Bahrain.

First: User Obligations

  • Use the Platform only for lawful and authorized purposes, and refrain from any behavior that disrupts its operation or causes harm.
  • Provide accurate, complete, and up-to-date information when registering or making bookings, and promptly update it when changes occur. The user acknowledges that submitting false or misleading data may result in legal liability.
  • Keep login credentials (username, password, authentication codes) confidential, do not share them with others, and assume full responsibility for all activities carried out under the account.
  • When entering third-party data (e.g., booking on behalf of someone else), the user confirms they have obtained prior and explicit consent from that party for processing their data in line with the Platform's Privacy Policy.
  • Respect intellectual property rights and do not copy, reuse, or publish any content from the Platform without written authorization.
  • Comply with any identity verification / due diligence (KYC/AML) requirements requested by the Platform or regulators, and provide the necessary documents when required.
  • Users must be at least 18 years old. The Platform reserves the right to suspend any account that does not meet this requirement.

Second: Prohibited Activities

The following are strictly prohibited:

  • Submitting or publishing any content that is illegal, offensive, promotes hatred or discrimination, or infringes on third-party rights.
  • Fraud, deception, providing false documents/data, or using payment methods without authorization.
  • Attempting unauthorized access to the Platform's systems/servers, bypassing security or technical controls, or uploading malware/viruses.
  • Using automated tools (Bots/Scrapers) to extract data or make bookings without written approval.
  • Using the Platform for unauthorized commercial purposes or promoting external entities without written consent.
  • Interfering with other users' services, disrupting operations, manipulating prices, or tampering with display methods.

Reporting to Authorities: The Platform reserves the right to notify regulatory or judicial bodies if there is suspicion of illegal activity or violations of local or international law.

Third: Service Provider Obligations

  • Deliver services exactly as described in listings and confirmed bookings, and refrain from altering prices or terms after booking unless approved by the customer.
  • Comply with all relevant local and international laws, regulations, and required tourism/service licenses.
  • Respect customer privacy and avoid sharing their data beyond what is necessary to deliver the service, in line with the Privacy Policy and signed agreements.
  • Assume full responsibility for any damage resulting from data breaches, violations of data protection laws, or breaches of commercial regulations.
  • Clearly disclose cancellation/refund policies, applicable taxes/fees, and any restrictions or prerequisites in advance.

Fourth: Platform Responsibilities

  • The Platform operates as a technical intermediary connecting users with service providers and strives to maintain a secure digital environment in line with best practices.
  • The Platform makes reasonable efforts to verify that service providers comply with quality standards and regulations but does not bear direct responsibility for the service itself, except in cases of proven gross negligence attributable to the Platform.
  • The Platform is not liable for damages or losses arising from user misuse of services, provider negligence, or circumstances beyond its control.

Fifth: Violation Procedures

In the event of a breach of this Usage Policy, the Platform may take one or more of the following actions:

  • Issue a written warning to the user.
  • Temporarily suspend the account or restrict certain features.
  • Permanently terminate the account and block access.
  • Notify relevant authorities or pursue legal action when necessary.

Right to Appeal: Users may appeal disciplinary actions within seven (7) days of notification through the contact channels provided below. The Platform will review the appeal and respond within a reasonable timeframe.

Sixth: Amendments

  • The Platform reserves the right to amend this Usage Policy from time to time.
  • Users will be notified of material changes via email and/or through the Platform prior to their effective date within a reasonable notice period.
  • Continued use of the Platform after the effective date of amendments constitutes acceptance of the revised policy. If the user does not agree, they may stop using the service and close their account.

Eighth: Relation to Other Documents

This policy must be read together with:

  • Terms & Conditions
  • Privacy Policy
  • Any other policies or appendices published by the Platform (such as the Cancellation & Refund Policy).

In case of conflict, the Terms & Conditions shall prevail as the general reference, and the English version shall serve as the binding original where specified.

Ninth: Governing Law & Jurisdiction

This policy is governed by the laws of the Kingdom of Bahrain, and Bahraini courts shall have jurisdiction. However, by mutual written agreement, parties may refer disputes to commercial arbitration through the GCC Arbitration Center or another agreed center, with proceedings conducted in English unless otherwise agreed.
